Unfortunately, though, a lot of the information you have is probably incorrect.</p>
<p>Following is a list of some of the most common misconceptions couples have about divorce law and what to expect from the  marital dissolution process:</p>
<p><strong>1. Only one parent has rights to full custody of the children.</strong></p>
<p>In the state of Texas, courts talk about &#8220;conservatorship&#8221; and &#8220;access,&#8221; as opposed to &#8220;custody.&#8221; &#8220;Conservatorship&#8221; refers to the set of rights and duties that accompany being a parent. &#8220;Access&#8221; refers to the block of time when the non-custodian parent is able to visit with the children apart from the other parent.</p>
<p>Courts try to divide conservatorship between both parents wherever possible<strong></strong>. However, one parent may be appointed the primary managing conservator who is in charge of making important life decisions for the children.</p>
<p><strong>2. If one spouse doesn&#8217;t pay child support, then the other can block access to the children.</strong></p>
<p>A parent cannot disregard court orders for visitation even if the other parent is delinquent on child support payments. Law is the law and you must follow it to the letter.</p>
<p><strong>3. If a spouse leaves a household and family because of domestic violence, then that action constitutes abandonment.</strong></p>
<p>This is false. Legally speaking, abandonment is defined as a failure to support children for six months or more OR living apart from the family unit for two years or more.</p>
<p><strong>4.  A husband and wife who have not lived together for months or years are legally separated.</strong></p>
<p>No legal separation exists in Texas.  If you don&#8217;t have the divorce decree, then you are still considered to be married no matter how long you have lived apart from your spouse.</p>
<p><strong>5. A person who has cheated on his or her spouse automatically loses rights to all property in the marital estate.</strong></p>
<p>While infidelity is grounds for divorce in Texas, it does not usually result in a division of assets that favors the  faithful spouse. The only time when infidelity may impact property issues is in cases where the cheating spouse exposes the children to highly inappropriate situations–for example, sexual activity or anything else that compromises their health, safety or welfare.</p>

But if you or someone you love has, then you need to know what to expect if you get arrested in Texas for driving while intoxicated (DWI) or, if you are a minor, driving under the influence (DUI).</p>
<p>DWI indicates that a driver:</p>
<ul>
<li>cannot safely operate a vehicle due to impairment by either drugs or alcohol;</li>
<li>is intoxicated to a level that&#8217;s above established DWI standards, as determined by a blood-alcohol concentration (BAC) test.</li>
</ul>
<p>In Texas–which is a zero-tolerance state–you can be charged with DWI even if your blood alcohol level falls below the accepted maximum of .08%.  A first offense for a DWI is a class B misdemeanor. However, if you are arrested with a blood alcohol of .12% or higher, you may face felony charges, particularly if you have been convicted of a DWI in the last 10 years or caused an accident with injuries.</p>
<p>If you are under the age of 21, then getting caught for drinking and driving can result in a DUI charge. For a 1st DUI offense, possible penalties may include a 60-day license suspension, a fine of up to $500, community service and mandatory enrollment in an alcohol awareness program.</p>
<p>If you are under 18, similar penalties apply but a parent or guardian must accompany you at all of your court appearances. If the blood alcohol exceeds the maximum .08%, a court may decide to fine you up to $2000 and impose a one-year license suspension as well as a 180-day jail sentence.</p>

Whether you are asked to describe it on job, housing and educational loan applications or are pulled over for a traffic stop, others will want to know whether your past includes incidents of breaking the law.</p>
<p>Fortunately, Chapter 55 of the Texas Code of Criminal Procedure offers those with a criminal past to clear their records through expungement and orders of nondisclosure. If you are granted either an expungement or order of nondisclosure (or in the case of those under 18, a motion to seal a juvenile criminal record), arrest records and convictions for certain crimes will be permanently deleted from your record. That means criminal information will no longer be available to the public when background checks of any kind are run on you.</p>
<p>Expungement means that records they are removed from all criminal history databases. An order of nondisclosure is slightly different in that it gives applicants the right to not disclose prior arrests, crimes for which he or she was acquitted or pardoned and convictions for which the applicant successfully completed conditions of public service, counseling or probation/parole. Both are designed to help applicants regain public respectability and the opportunities that come with it.</p>
<p>Where young people are concerned, Texas laws allow for the sealing of juvenile records under some circumstances, which makes those records unavailable for any purpose at any time.  This means that a child with an otherwise unblemished record can apply for scholarships, student loans, public educational grants and on-campus housing when he or she goes to the university.</p>

			<content:encoded><![CDATA[<p><img class="alignleft size-medium wp-image-682" title="Divorce can be upsetting for children" src="http://www.barrera-lawfirm.com/84rr3rA/wp-content/uploads/2012/04/757575xv4brji4f-300x199.jpg" alt="" width="300" height="199" />If you are a mother or father seeking a divorce in Texas, then you should know that state courts are not inclined to award custody of children to one parent. That&#8217;s because the Texas Family Code strongly recommends that parents should try to cooperate in raising their sons and/or daughters after the dissolution of the marriage.</p>
<p>When parents divorce, most state courts ask who will have child custody. In Texas, it&#8217;s slightly different. Courts in the Lone Star State will ask who will have child conservatorship. Wording is important here because  conservatorship speaks to caring for and protecting offspring rather than, as in the case of custody, possessing them.</p>
<p>A Texas court may appoint either joint managing conservators or a sole managing conservator. Joint managing conservatorship means that two people (usually the parents) share the traditional rights and duties of parenthood. In joint conservatorship, the court may give a particular right or duty to each parent independently or leave them to work out those duties together. In sole managing conservatorship, those rights and duties fall to just one parent.</p>
<p>If one parent is appointed the sole managing conservator, that individual can decide where the child live. The other may be appointed the possessory conservator or parent with the right to visit the child according to the conditions in the court order.</p>
<p>Texas law focuses on the child&#8217;s best interest and supporting continuing relationships with both parents wherever possible. However, the presumption favoring joint managing conservators can be overturned by three things:</p>
<ul>
<li>a history of family violence</li>
<li>previous relinquishment of a child&#8217;s care for at least one year</li>
<li>danger that joint appointment is not in a child&#8217;s best interest because it would impair a child&#8217;s physical health or emotional development</li>
</ul>
<p>What all of this ultimately means is that if a mother and father were decent parents during the marriage, they will likely get a chance to continue to parent as joint managing conservators after the marriage is over.</p>

In Texas, the number of these kinds of accidents has hit all new highs. A recent CBS DFW online article reveals that in 2011, “[t]he Texas Department of Transportation (TDOT) [found] there were 329 wrong-way crashes statewide…[and that] more than half [took place] in Dallas County.”</p>
<p>A  TDOT study conducted in 2010 showed that alcohol was the common denominator in  nearly all of these crashes. According to one TDOT official, about three-quarters of all the drivers involved in wrong-way crashes were under the influence.</p>
<p>The human toll these kinds of accidents take lingers long after the event itself. One woman named Gwen Edwards who lost her son Louis in a wrong-way crash a year a half ago on Interstate 35 still reports her feelings as, “Anger, yes. I still have a lot…[l]osing a child is a lot different than losing a mother, father, sister or brother.” Louis was just 22 years old and was the only one who perished.</p>
<p>Edwards is still grieving for her son. She has since “turned to Mothers Against Drunk Driving (MADD) for help and says that more needs to be done to protect drivers on the road.” In her view, “[t]he drunk driving laws keep the drivers safer than [they do] the victim. The laws need to be stiffer.”</p>
<p>This coming September, TDOT will begin to research countermeasures against wrong-way driving. “The main goals will be to identify what methods are most successful in getting the attention of impaired drivers, and finding out which countermeasures are most effective and properly orienting the wrong-way driver for alerting them to the fact they&#8217;re going the wrong way.”</p>

<p><em>The Drugs</em><br />
These drugs, usually called SSRIs, have been commonly prescribed to pregnant women and are associated with causing various birth defects in new born children. The most common defects are heart, lung or cranial defects, cleft lip or palate and club foot. “It is extremely troubling,” stated Ricardo Barrera, head of the firm, “that pregnant women have trusted in the manufacturers of these drugs to provide a safe and tested product only to find out that their children are now paying the heavy price.”</p>
<p><em>The Studies</em><br />
In the recent past, the British Medical Journal published a study that infants born to women who were treated with SSRIs in late pregnancy carried twice the increased risk of a specific heart defect than infants born to women not on SSRIs. And the FDA, as early as 2005, issued a warning that Paxil, a prominent SSRI, “increases the risk for birth defects, particularly heart defects, when women take it during the first three months.”</p>
